1. What LocalSay is
A traveller asks the people who live in a city a question with a clock on it. Locals vote — people whose home city it is, with a verified mark on votes cast from inside the city. When time runs out, the answer is whatever that city chose. Locals can also write a plan for a traveller's free hours.
What locals say is their opinion, not our advice. We do not check that a place is open, safe, good, licensed, or suitable for you. A winning option means some people in that city picked it; nothing more. Use your judgement, as you would with a recommendation from a stranger in a bar — which is exactly what it is.
2. Who can use it
You need to be 16 or over and have an Apple account. One account per person.
You sign in with Apple; there is no password. Keeping your Apple account secure keeps your LocalSay account secure, and anything done from your account counts as done by you.
3. What is free, and what is paid
Asking is free. Voting, suggesting places, writing plans and everything a local does is free and always will be — locals are what the app runs on, and charging them would be charging the wrong side.
Local Pass is paid, and unlocks asking locals to write you a plan for your free hours:
- Seven days — €5.99. One payment. It does not renew.
- A year — €24.99. Renews every year until you cancel.
Prices are shown in your own currency by the App Store before you buy, and Apple's price may differ from the figures above in your country.
Payment, renewal, cancellation and refunds all go through Apple, not us. Cancel a renewing pass in Settings → your Apple Account → Subscriptions, at least 24 hours before it renews. Refunds are Apple's to give; we cannot issue them, though we will help you ask.
By buying a pass you ask for immediate access and accept that, once the pass is active, your 14-day right of withdrawal under EU law is spent for the part you have used.
We may change prices. A change never affects a pass you already paid for.
4. What you post
Your questions, options, suggestions, plans, messages and reviews stay yours. By posting them you let us show them in the app and, for a settled question or a chosen plan, on a public web page that anybody can open without an account. Those pages name the city, never the asker.
Do not post: anything illegal; advertising or spam; somebody else's private information; a place you have an undisclosed interest in; abuse, harassment or hatred of anybody; or content you do not have the right to post. Do not impersonate anyone, do not run more than one account, do not try to swing a vote with extra accounts, and do not scrape the app.
We can remove content and suspend accounts that break these rules. There is a report button on questions, options and plans.
5. Guide accounts
Some accounts in each city are run by LocalSay rather than by a resident. They vote, suggest places that have been chosen here before, and ask about one question a day, so that a city is not empty on the day it opens. On a question nobody real has voted on, they cast at most two votes on two different places, so no question ends with a winner nobody chose. Settings → About says the same thing inside the app.
6. Points and standing
Points, ranks and leaderboards are a way of recognising people who answer. They are not money, they have no cash value, they cannot be transferred, and we may adjust them to correct abuse or a mistake.
7. What we promise, and do not
We try to keep LocalSay running and to keep your data safe, but it is offered as it is. We do not promise it will always be available, that answers will arrive, or that a plan will suit you. A question can close with no answer, and paying for a pass does not buy a plan from anybody: it buys the ability to ask.
Nothing here limits our liability for intent or gross negligence, for injury to life, body or health, or anything else that cannot be limited under German law. Otherwise our liability for simple negligence is limited to duties essential to this agreement and to the damage typically foreseeable for a service at this price. Your statutory consumer rights are unaffected.
8. Ending it
Delete your account any time in Settings → Delete account. Your identity is destroyed; votes and finished questions stay attached to an account that is now nobody, because they are part of other people's results. The privacy policy explains this in detail.
We may suspend or close an account that breaks section 4, and will say why unless the law stops us.
9. Changes
We may change these terms. If a change matters, the app will say so before it takes effect; if you do not accept it, delete your account. The date at the top always reflects the current version.
10. Law
German law applies, and if you are a consumer you keep the protections of the law where you live. Disputes go to the courts with jurisdiction; as a consumer you can also sue where you live.
